LINCOLN, Neb. (AP) -- A former substitute teacher accused of having a sexual relationship with a student has been sentenced to up to 12 years in prison.

Terry Schmutte pleaded no contest to attempted first-degree sexual assault of a child in July. The 40-year-old had originally been charged with first-degree sexual assault but that charge was lowered in a deal with prosecutors.

He was sentenced in Lancaster County District Court to between 10 and 12 years in prison late last month and received credit for nearly a year served.

Schmutte will be eligible for parole in 2009.

Authorities accused the former Lincoln Southwest High School assistant track coach and substitute teacher of having a relationship with a now 17-year-old girl since June 2003. Schmutte and the girl went to Canada in September last year and were arrested about two weeks later.
