A court hearing scheduled to begin in Madison County District Court Monday morning will help determine whether Norfolk bank murderer Erick Vela gets the death penalty.
At issue is Vela's mental capacity. If Vela is found to be retarded, he will be ineligible for the death penalty.
Vela, Jose Sandoval, Jorge Galindo and Gabriel Rodriguez have been convicted of killing five people in a U.S. Bank branch in September 2002.
Juries found Vela, Sandoval and Galindo eligible for the death penalty.
Sandoval and Galindo both have been sentenced to five death sentences. Rodriguez was sentenced to five consecutive life sentences.
