A mistrial has been declared after a jury deadlocked in the case of a Roca man charged with first-degree sexual assault.

A new trial for 48-year-old Michael Bennett is now set for February.

The Lancaster County jury had been deliberating since Friday afternoon, following a five-day trial. It reported on Monday afternoon to District Judge Steven Burns, telling him there was no chance of reaching a verdict.

Bennett was arrested June 1 after allegedly raping a woman at a home he shares with a girlfriend.

Authorities said the girlfriend's son walked in on the encounter and then beat Bennett. The son was arrested for assault, but that case was later dismissed.
