Attorney General Appeals Probation in Sex Case

The Nebraska attorney general is appealing the probation sentence given to a man convicted of having sex with a teenage girl.
Chad Red, of rural Waco, was sentenced to two years' probation for attempted sexual assault of a child on Monday. He pleaded no contest to the charge in a deal with prosecutors.
Attorney General Jon Bruning says the sentence handed down by York County District Judge Alan Gless was too lenient. He wants Red to serve time behind bars.
Attempted sexual assault of a child carries a maximum sentence of 20 years in prison.
Authorities had accused Red of assaulting a girl who was 13 when the two began having sexual relations in August 2005. The sexual encounters continued for two years.

I wonder if the man would have received probabtion if it were Gless' 13 year old daughter who had been involved?????
