Butts Out Nebraska, The Smoking Ban's Here
Lincoln State Health officials want businesses to be in compliance when the state's smoking ban goes into affect Sunday at midnight, and say they have several ways to make sure everyone followes the law.

Right on cue with World No-tobacco Day, Nebraska's Clean Indoor Air Act goes into affect Sunday at midnight meaning butts out Nebraska.
"The scientific debate over the dangers of second hand smoke is over, we know it causes damage to non-smokers," said Nebraska Chief Medical Officer Joann Schaefer. "There are studies out now that show when you go smoke free you actually lower the instances of heart attack."
The law bans smoking in all public places and businesses except cigar bars and 20 percent of hotel rooms. Reaction to the ban is mixed.
"I personally disagree with it," said Aaron Pavelka who works at Ron's Pub at 13940 "O" St. The bar allows smoking and Pavelka is a smoker.
"I think it's a wonderful thing," said Lincoln resident Fred Lovelace.
Either way, state health officials want everyone in compliance with the ban. Dr. Schaefer will be partially responsible for enforcing it.
"The first complaint that comes in, we're going to go out, either local health officials or people from our office, and try to educate the business and try and get them in compliance with the law," said Schaefer.
Dr. Schaefer said the ban will mostly be enforced on a local level. She's directing people with complaints to first ask the business owner to fix the problem. If that doesn't work or the business is the problem, she said to call the local health department.
There is also a law enforcement element to the ban. Lincoln's smoking ban went into affect at the beginning of 2007 with the Lincoln Police Department charged with enforcing it.
"I think the most affective thing we did leading up to the ban is let people know we would indeed be enforcing it," said LPD Chief Tom Casady.
Casady said enforcing Lincoln's smoking ban has been fairly painless. LPD officers handed out seven fines in the first hour the ban went into effect, but only four after that for all of 2007. In 2008 Casady said officers handed out eight citations. However, those citations can be pricey. The first offense will cost smokers or non-complying businesses $100. Subsequent fines are be $500.
Dr. Schaefer said she hopes law enforcement is a last resort for most cities and situations.
"The whole goal is to get people in compliance with this, not to hurt businesses or cause the unnecessary burdens."
Out at Ron's Pub smoking has been a staple, however they said they'll follow the rules.
"The smoking ban's going into effect at midnight, so no more smoking after midnight. But do come out and have one more cigarette with us," said Pavelka.
Dr. Schaefer meanwhile said this is a necessary law in a society increasingly rejecting smoking. According to the Centers for Disease Control nearly about 42 percent of the country smoked 40 years ago. Today less than 20 percent smoke.
Regardless, there will always be a debate between fresh air lovers and people who believe Nebraska is butting in.
"I think people have a choice as to whether they go into a smoking area or a non-smoking environment," said Pavelka.
"I don't want to breath it in because it's bad for my health," said Lovelace.
Dr. Schaefer said her and other health officials hope to soon see a decrease in respiratory disease throughout Nebraska. And she also said most states with a smoking ban see a slight reduction in the number of smokers, as people sometimes use the ban as a reason to quit.

I am not a smoker...but my parents are. I deal with secondhand smoke all the time, and i cannot begin to explain how much i have lectured my parents with no avail. They know they're ending their life sooner than needed be, and I guess that's their choice. But, they shouldn't end the lives of those (persons) around them. If you are a smoker, you should not smoke in front of someone it offends and bothers. If you need it so badly, find your own special place out of the public. Smokers are selfish and inconciderate of other human beings who choose a healthier way of life. I sometimes hysterically wish they could see that their smoking could kill me before it kills them. Their choice for purely them? No, they're chosing to shorten my lifespan as well.
my business has dropped over 30% since the smoking ban - over 80% of my customers smoked - (they still do just not here- maybe around their kids at home) i appreciate all those comments from non smokers that support the smoking ban - and i'm waiting for you to do business with me now that the ban is in place - but better hurry - or i will have to lay off the single mother, the great grandmother trying to supplement her social security, or the college student. I am patiently waiting to support more bans that will effect your life. For instance those people that can afford to go on vacation are a danger to me with their unnecessay driving creating more exhaust and talking on their cell phones. keep up the good work - your next - i hope
Just want to know where the state is going to get the money when everyone quits smoking. But then this is Nebraska and they have never cared about their people who live and work here. The only thing the government of Nebraska cares about are what they can get for free while the rest of us pay for it. This smoking ban is the worst thing to happen since NAZI'S took power in Germany.
Talking with an old gent, he was telling about his younger days fighting in WWII. Back then, fighting for our freedom, he had a cigarette in his mouth while being shot at. They got home, built a VFW club to reminisce. Now the do gooders won't let them smoke in their own club!
So... how do we fill the revenue gap? Does this mean nonsmokers will have to start chipping in to fund the schools,for example? I can't imagine smoking will just "go away". The more likely outcome will be a boom in the underground market. In any case, prohibition does not work. Ask any heroin addict.
It's simple. Tobacco contains nicotine. Nicotine is a drug, listed as a narcotic and is in the same class as morphine. It not only affects the smoker, it affects children who have no where to go to get away from it's deadly toxic fumes in their parents homes or cars. I was one of those children. Smokers only care about getting their constant fixes. Since I moved to lincoln with a smoking ban I have had ZERO asthma related emergency room visits due to smoking compared to several a month. Way to go Nebraska!! Smoking is deadly and should be treated like meth and all the other drugs. Smoking kills more people than all the other drugs combined!
More and more government control just like the socialists that run it! Pretty soon they will tell me what I can do in my own home! Keep out of my life government! You keep reaching further and further into what you can take away or tell me what to do!
Lets not have casinos, lets not have smoking, hell lets not have Nebraska!!!!!!! Time to move to a new state that don't ban everything. I always that Iowa meant idiots out wandering around. They must have come from Nebraska.
I have read the comments and agree and dissagree with some of them. First of all it's my right as a business owner to decide wether to or not to let my customers smoke. Secondly of all all of you non-smokers also have the right to stay of a public bar/cafe if there is smoking allowed. When are people gonna realize what is happening and who are you to tell me how to run my business. As of June 1 my business is down considerably! And that leaves me wondering how I am gonna pay my bills. Can anyone tell me? I know Obama's bail out money (yea right) On sale/off sale and cigarette are way down!! What is the state gonna do if everyone goes to another state to purchase cigaretts and beer and they loose that tax money? You guessed it...YOUR pocket!! I was always told that you never bite the hand that feeds you!! Well the legislature has done that and then some!! Hold on to your pocket books boys it's gonna be a bumpy ride!!
If you want to smoke but you can't smoke tobacco, smoke BluCigs. They are an electronic cigarette and don't use any tobacco to deliver the nicotine, just a water vapor. I can smoke them anywhere and they are cheaper than tobacco cigarettes, especially with all the taxes and bans they put on them now!
To 24 Year Ikd: Have you ever drank alcohol? It too is also very dangerous, but I bet there are more Educated Americans who drink than smoke. Have you ever chose a greasy hamburger and fries over a salad? It is a personal choice.
Why would you go to where they allow smoking if you don't like the smoke? (Prior to the NAZI ban) Do you eat fried foods? That is a health risk..better ban all fried foods!! There are SO many unhealthy habits can't ban them all. I am a nonsmoker by the way...
I SAID I WAS A NONSMOKER, dave. It is wrong for the governemnt to tell a proprietor that they can not allow smoking in their property! If the goverment wants to ban smoking then they should not collect the tax money from teh sale of cigarettes. Also you have a CHOICE of not going to the establishment that would allow smoking. Just as the smokers would have a choice to not go to a nonsmoking establishment.
I have never smoked. (I tell you this because I have been told that "I just don't understand") I don't understand and I admit that... why in 2009 when we are well aware of all the health risks of smoking do people still smoke? They are expensive (very high taxes on them), they stink (very very badly), they make your teeth yellow (they also discolor the paint on your walls if you smoke inside your home), if you smoke your health insurance is more expensive, it causes illnesses that then require expensive health care...so please someone out there please explain why you smoke? I am curious...it is 2009 and we are well educated Americans. I do not think we should have our rights taken away. I think we should be smart enough to make wise decision on our own...but that isn't happening.
Smoking is a privilege; breathing is a right. It's not an extension of our nature (in fact, it runs contrary to our nature.) But breathing, well, just try to stop breathing for a day, and see what happens!
