Nebraska Man Gets Probation for 3rd DUI Conviction

A 22-year-old York man has been sentenced to five years' probation and given credit for time served for his third drunken-driving conviction.

A 22-year-old York man has been sentenced to five years' probation and given credit for time served for his third drunken-driving conviction.

David Anderson was arrested in September last year after a hit-and-run accident in York.

His blood-alcohol level tested out at 0.299 percent, more than three times the legal limit of 0.08 percent.

Anderson was charged with a Class 3A felony, which carries a maximum sentence of five years, and three lesser charges. In a deal with prosecutors, the other three charges were dropped, and Anderson pleaded no contest to DUI.

Judge Alan Gless of York County District Court told Anderson Tuesday that this was his last chance, that the "next step is prison time."

He didnt get off that easy I have gotten Dui's before. He did some jail time allready hince the workd time served. Loss of licensce for 15 years, probation @ 30 a month plus testing feesnfor five years, thousands of dollars in fines. A felony on his record hard to find a job. Probably inpatient or out patient treatment. Thousands of dollars in debt. If he brakes any rules straight time with the real convicts. I feel bad for him hopefully he can recover instead of going the other way.

What ever happened to the days when people took responsibility for their actions. Do the crime, do the time. Maybe this judge will think differently when this or others that have been slapped on the wrist for DWI's, especially repeat offenders ends up killing a family member or friend. I do agree that it's society that has brought on this change, if the law would still allow parents to firmly discipline, spankings that get their attention, etc... and I don't mean to beat their children, to take responsibility for their actions at a young age then maybe our world would not be in the shape it's in. Parents use to march their kids in to the police station when they did wrong, if they took a piece of candy they were made to go back in and pay for it, what happen?? All of these do gooders that had to stop the "beatings", a spanking never hurt me and surely won't hurt my kids either, maybe these so called parents of today need a reality check, this kids are our next presidents, etc... SCARY!

WOW!! Probation for 3rd offence dui!? I get 2yr probation and 30 days for 2nd offence! .299 is a higher than my bac was and by all means he shouldn't get another chance! Obviously having problems with legal drinking should be taken seriously and obviously aren't by some!!

People that r caught driving under suspension get 1-3 yr. in prison. But drunk drivers get hand slapped for 2-3x driving drunk.

Hey, Anonymous - the judge gave him a pass not society. When this guy gets behind the wheel of a car and causes harm to someone are you going to blame society then or the judge that gave him the free pass and granted him his freedom once again??

This guy needs to be going to jail before petty drug offenses. This is far more dangerous behavior. People don't get killed when someone walks around with a joint in their pocket. People do get killed when someone drives with a BAC of 0.299%. If the jails are overcrowded, it's time to re-assess priorities.

Don't like it. Then Vote him out! Take a look at all the judges and what is going on. Look to Washington and vote them out. Seek the truth though, because there are some good ones.

I agree with Susuan from Lincoln. This kid has a problem and should be put into some kind of rehab and then in jail. I wonder MR JUDGE what you will think when this kid gets drunk again and kills an innocent person. No wonder we have so many fricking accidents in this world.

Third offense and NO jail time? This just doesn't seem right. How many strikes does a person get? Probation - now THAT's a deterrent...I guess he'll get more than a slap on the wrist next time?! Next time, someone could be injured or killed. On this guy's third offense, he tested BAC 0.299%. For most people, that means passing out or going into a coma. But let's just give him probation. Wow.

If EVERY judge would throw the book at EVERY drunk driver, instead if just slapping their hands, the roads would be safer. And after people get the idea that they will really get punished for driving drunk, some of them will use better judgement. Eventually, law enforcement officers and judges would be able to devote more time to catching burglars, rapists, drug dealers, etc. And they should give them the maximum penalty EVERY time, too!

This is his "last chance" to kill someone, maybe. Who knows if the next time, and there will be a next time, the judge will say the same thing. Once is a mistake, more than once on a DUI a is driver allowed to kill at will. Driving is not a right!

Probation, give me a break! Probation maybe for the first offense, jail the SECOND offense. Its his 3rd offense you really think hes gonna stop driving drunk??? Sad when people get jail time and thousands of dollars in fines for stealing and embezzling money but get off with probation for driving around drunk...gotta love our judicial system!

maybe if they started impounding cars for people who drive drunk they would stop. start taking way the vehicle. Cars, trucks, sus's are all expensive to come by. just a suggestion, but DRUNK DRIVING IS UNACCEPTABLE. Boo to the judge who gave this loser probation. no wonder it's his thrid offense. he's been getting a slap on the wrist the whole time, and his actions have never caught up with him
