Man Struck by Police Dies

Justin Nealon was critically injured while walking home in the early morning hours Feb. 22. He was returning from visiting friends when he was hit while crossing a stretch of West Center Road not marked for pedestrians.

Omaha Police Officer Brian MCkenzie, who was driving the cruiser, said he did not see Nealon.

A police report said factors contributing to the accident included poor lighting in the intersection, no sidewalk or crosswalk, and the fact that Nealon was wearing dark clothing.

McKenzie remains on duty, and Omaha City Attorney Marty Conboy said criminal charges are not likely.
