Prosecutors will not seek the death penalty against Gabriel Rodriguez in the U.S. Bank murders in September 2002.
Jury selection started Monday in Madison County District Court.
County Attorney Joe Smith amended the complaint against Rodriguez to say the death penalty will not be sought.
Rodriguez faces five counts of first-degree murder and five convicted, Rodriguez still could get five life sentences.
Rodriguez is accused of being the lookout man and not inside the Norfolk bank when five people were shot and killed.
Three other suspects inside the bank have been convinced in their trials on similar charges.
