An attorney for Douglas County's chief crime-scene investigator charged with evidence tampering in a 2006 double-murder case has asked that the court throw out his client's criminal case.
Omaha attorney Steve Lefler and his client David Kofoed appeared Monday in Cass County District Court.
Kofoed helped investigate the murders of Wayne and Sharmon Stock more than three years ago in rural Murdock. Prosecutors have said Kofoed's actions led to two innocent men being wrongly charged and jailed for the slayings. They were later cleared.
Special prosecutor Clarence Mock has two weeks to respond to Lefler's arguments.
Cass County District Judge Randall Rehmeier says he'll rule on the request within the next several weeks.
