Nebraska has fired its next-to-last shot in its fight to avoid paying a $151 million judgment in a radioactive waste dump lawsuit.
Attorney General Jon Bruning asked the entire Eighth US Circuit Court of Appeals to review an earlier ruling by one of its three judge panels.
If the appeal fails, Nebraska's only remaining chance is to ask the U.S. Supreme Court to hear the case.
The appeals court panel last month upheld an earlier ruling by U.S. District Judge Richard Kopf of Lincoln.
Kopf ruled former Governor Ben Nelson engaged in a politically motivated plot to keep the regional dump from being built in Nebraska.
The dump was to hold waste from Nebraska, Kansas, Arkansas, Louisiana and Oklahoma.
All those states are members of the Central Interstate Low-Level Radioactive Waste Compact.
