Nebraska Human Remains Case to Stay in Adult Court

A York teenager accused of illegally disposing of the remains of her stillborn baby will be tried as an adult.

York County District Judge Alan Gless this week denied a request from Kaitlyn Smith's attorney to transfer the case to juvenile court.

In his order filed Wednesday, Gless said he made the decision, in part, because the adult court system has more resources to help Smith.

Authorities say Smith, now 18, gave birth to a stillborn girl on Jan. 26. They say she put the body in a trash bag and placed it in an outside trash receptacle. The remains were discovered days later at the York landfill.

Smith pleaded not guilty in June to the felony charge. An Oct. 20 hearing is set for her to resubmit a plea.
