Nebraska American Civil Liberties Union's Tim Butz says he is pleased with Wednesday's Eighth U.S. Circuit Court of Appeals ruling to remove a Ten Commandments monument from a Plattsmouth city park.
He calls the decision a major First Amendment victory.
The majority opinion noted the city of Plattsmouth, "Abandoned its duty to religious neutrality and acted with the intent of promoting a particular point of view in religious matters."
Butz says the decision vindicates the lawsuit's position that the monument belongs on private property, not public property. He says that would remove the appearance of government endorsement of its religious content.
ACLU attorney Sue Ellen Wall says, "It is critical to the well being of religion that it be protected from entanglement with the state."
