That comes after the Eighth U.S. Circuit Court of Appeals upheld a ruling that the state owes $151 million for trying to block construction of a low-level radioactive waste dump.
The appeals court upheld an earlier ruling by U.S. District Judge Richard Kopf of Lincoln.
Kopf ruled former Governor Ben Nelson engaged in a politically motivated plot to keep the regional dump from being built in Nebraska.
The dump was to hold waste from Nebraska, Kansas, Arkansas, Louisiana and Oklahoma. All those states are members of the Central Interstate Low-Level Radioactive Waste Compact.
Nebraska's options include asking the Eighth Circuit to rehear the case or petitioning the U.S. Supreme Court.
Johanns said he plans to begin talking to lawmakers about trying to find the money to pay the judgment should Nebraska lose.
