Nebraska Attorney General Jon Bruning has backed off an earlier argument that a 12-year-old girl had consensual sex with a 17-year-old boy placed in foster care in her home last year so the state shouldn't be liable for damages.

Bruning changed positions Wednesday afternoon after The Associated Press reported his office's defense strategy in the case where a 12-year-old Grand Island girl has sued the state, alleging emotional and psychological damage.

Bruning said he's spent his career protecting children so he will not allow the defense strategy to be used now or ever.

Bruning knew of the strategy a week ago.

Grand Island attorney Mark Porto represents the girl and called the previous stance surprising and strange.
