Ivan Henk's attorney is asking for a change of venue for his client's pending first-degree murder trial.
Attorney Jerry Soucie filed a motion in Sarpy County District Court Thursday, saying his client cannot get a fair trial in Cass or Sarpy County because of new media coverage of the case.
He is asking that the trial be moved to another county.
Henk is accused in the death of his four-year-old son, Brendan Gonzalez, whose body has not been found.
In his motion, Soucie says not only did the case dominate the news, but members of the community volunteered to search for the boy's body. Soucie says those volunteers could be called as jurors.
Brendan disappeared Jan. 6, 2003.
Soucie asks that the trial be moved to Douglas, Lancaster, Hall or Buffalo County.
Or, Soucie proposed, Sarpy County could house the trial, but jurors could be brought in from Douglas or Lancaster County.
Sarpy County District Judge William Zastera will hear arguments on the request to move the trial July 12.
Zastera has yet to rule on Soucie's previous request to suppress evidence in the case. Arguments were taken during a multi-day hearing in February.
