A Nebraska judge has decided that 73 days spent in a community re-entry program didn't count as time served for a 56-year-old man who was resentenced for two drunken-driving convictions.
Lancaster County District Judge Robert Otte made the ruling Thursday when he resentenced William Parminter.
In April the Nebraska Supreme Court said Parminter's initial sentences were excessively lenient.
He was arrested in May 2010 and again in January 2011.
After he was convicted, he was given sentences of 12 to 18 months and 12 to 24 months, to be served at the same time.
The high court ordered that Parminter be given two sentences of five years, to be served consecutively.
The drunken-driving charges were Parminter's eighth and ninth.
