No Ruling from Judge in Nebraska Mining Dispute

A Scotts Bluff County judge has issued no immediate ruling in request from the county for a temporary or permanent injunction to stop a company from mining sand and gravel near the North Platte River on the west edge of Scottsbluff.

Judge Randy Lippstreu has taken the request under advisement.

The county maintains Western Engineering is illegally mining because a conditional use permit for the mining expired in 1993.

The company says the mining is legal and cites a letter from former Public Works Director Rick Meter in which he says he had no objections to the specific location on the mining.

The judge says he'll do his best to have a timely decision but says it may be difficult for him to do this month because of a busy trial schedule.
