The Nebraska Supreme Court has ruled that an Omaha man convicted of murdering a friend didn't prove that testimony from another witness would have changed the outcome of his trial.
The court decision released Friday says a lower court was right to deny Eric McGhee an evidentiary hearing in his latest appeal.
McGhee is serving a life sentence in the 2003 killing of 21-year-old Ezra Lowry. Court records says McGhee shot Lowry in the head while the two men were playing pool.
McGhee's conviction and sentencing were previously upheld by the state Supreme Court.
In his latest appeal, McGhee says his public defender should have called another expert to testify about McGhee's mental state during the shooting and his fitness to stand trial.
