Updated Lincoln Boy Recovering After Pit Bull Attack

Lincoln Animal Control officials say a 10-year-old boy had to get 30 stitches after being attacked by a Pit Bull Wednesday afternoon.

Animal Control Director Robert Westfall says the boy, Baylee Harris, was riding his bike in an alley in the 3600 block of Huntington Avenue while 51-year-old Lisa Burton was walking her 10-month-old Pit Bull, King.

Westfall says the dog pulled away from Burton, knocked the boy off his bike and bit him several times in the head, face and arms. Harris was taken to the hospital for 30 stitches.

"He made me fall from my bike by getting front of me," said Baylee. "So I slammed on my brakes and I fell off and the dog started biting me.

And the dog continued to biting. Baylee said he tried to kick the dog away, but it was too strong.

"When I got outside he was covered in blood and there were two people already on the phone to 911," said Heather Harris, Baylee's mother.

Neighbors stood by horrified.

"I tried to help but it all happened so fast. By the time I got over there the kid was already on the ground bleeding," said Mitchell Moore, a neighbor.

According to Westfall, The dog is in custody.

"Our officers who responded to the call described the dog aggressive," said Westfall. "This will definitely fall under the category of dangerous or viscous."

Westfall said Pit Bulls are the leading breed when it comes to reported attacks in Lincoln. He said 38 pit bull attacks have happened since September. However, he said his department doesn't yet support breed specific laws, and Lincoln doesn't have any.

"We don't feel we have enough evidence to show a breed ban will work in Lincoln," said Westfall.

However, Baylee's mother said her son is all the evidence she needs.

"Not just Pit Bulls, all dangerous dogs," said Heather Harris. "I think there needs to be stricter laws."

"I'm lucky he didn't get deep down in my bones and he didn't kill me," said Baylee.

As for future fears...

"I'm kind of scared still."

But he too is only critical of the breed.

"Yes, I will be scared of Pit Bulls. But will I be scared of other dogs? no," said Baylee.

Animal Control cited Burton for having a dog at large and not having a license for the dog.

Even with 30 stitches Baylee went to school Thursday. His mother said he's a brave boy, but also said the attack made him scared of big dogs. Heather Harris said she is upset this happened, and wishes dog owners were more in control of their dogs.

Westfall said he will declare the dog either dangerous or vicious at the end of his investigation which should wrap up in the next two days.

A vicious declaration means animal control will take the dog from it's owner. A dangerous declaration requires a $35-per-year fee, notifications if the dog is moved and a special kennel. Since Burton lives in an apartment and won't likely be able to construct a kennel, she will likely have to give up the dog no matter the designation.

Westfall said there are 851 Pit Bull and Pit Bull mixes licensed in Lincoln.
Since September of 2008 there have been 38 Pit Bull bites in the city. The next closest breed in number of bites are Labs at 27 and German Shepherds at 21

jp since you didn't ask and assume people that own pitbulls are just plain stupid, I am here to give you a little insight. Though I have a child and own a pitbull doesn't mean I leave them alone together. I would not even do that with a pug! I am not asking everyone to like pitbulls, but I am telling you to take a second look at the owner. Was the owner properly walking the dog with a leash, was the yard the dog was in properly fenced? Was that animal treated right or was it neglected? My pitbull is now 4 years old and we have not had any trouble, everyone that has met her say that she has made somewhat of an impact on their views of pitbulls. Believe what you like but do understand the dog LEARNS from it's OWNER, and they are very LOYAL to their OWNER, before blaming the breed take a good look at the OWNER!!!

i want to make it very clear to everyone that before you speak yo should try to get to know the breed!i have had a number of dogs in my life living in the country people drop off dogs when they dont want them any more. ive been through labs, australian shepherds, german shepherds, pugs, chows ,heelers, muts and so many more and last year a friend gave ma a 6 week old pit. before you try to send me to prison or kill my dog meet her she loves to be loved on! before you say get a dog with smaller teeth let me inform you i had a min yorkie of 3 lbs bite my thumb open and my chihuahua has tried to bite more times than i can count and shes less than 5 lbs! fluffy my pit has never been agressive to other living things and cant figure out why our outside cats wont play with her she didnt kill the chickens or even harm them she will submit to any other dog yes even the small ones and roll over showing they are the boss so do not judge a dog by the breed there are alot of people out there that

You are an idiot to own a pit bull. They are vicious and unpredictable to say the least. Why take the chance when statistics show they are the most dangerous dog around. Funny that so many people with children own them.....that is negligence and endangering your child. Pit bulls are opportunistic and strike out of the blue.....IT'S A FACT. Nothing but accidents waiting to happen. I really don't trust dogs around kids so I believe if you must have a dog and children in the same house- get a dog with small teeth.

Stats always prove the facts. Pitbulls cause more attacks than any other breed. Pitbulls started with in-breeding and always are phyco and unpredictable. Pitbulls should be declared an illegal breed to even own. Any person that owns either a pitbull or rottweiller should be sent to prison for no less than one year for the first offense. Ten years for the second one and climbing from there. to Emily, yes pitbulls are just plain phyco, cowards and attack when provocted and have an advantage to mall or kill a small child or older person. My daughter came running to me when my grand daughter was bitten in the face by their dog when the girl was four. The breed is just plain insane from birth.

i think that you need to just let it go i have a 4 month old pitt and hes a huge baby hes scared of little yippy dogs and a pinch collar is why. it works you just have to try it. i dont think they should be banned at all. punish the deed not the breed. stop stereotyping the dogs its not theyre fault.

ok attention to all you people that think it is in a dogs nature to attack people and kids it is not they have it in their nature to protect themselves but each individual dog breed does not have its own nature they all have the same nature so don't attack the stronger, meaner looking dogs because their owners are idiots. I have a pit and a one year old son but I have trained my dog well enough and still teach her that you do not hurt anyone at anytime for any reason. Meet my dog and then I will gladly listen to the people that dislike "PITBULLS"

Hmmm...Time to get a new A/C Director...He failed to mention that there are nearly 5500 Lab/lab mixes registered in Lincoln. Why is he making excuses for the Pit Bull community? And why did this woman only receive a $150 fine for known previous biting pit mauling this boy?

A Pit Bull is only as dangerous as IT'S OWNER makes it. I am a vet tech and I have worked with dogs for years, and I have to say that the Pit Bulls that come in our office are very sweet dogs. Only once have I saw a mean Pit Bull. And that was walking down a street in my neighborhood, it was owned by a thug that doesnt take care of it. Good owner=good Pit Bull Bad owner=bad Pit Bull. It's not rocket science folks!

I have read many of the previously posted comments and all of the negative statistics that have been quoted are false. I understand that most people who support BSL are just misinformed and hope with the proper information they will rethink their position on the matter. I would like to send best wishes to Baylee Harris and thank his mother for understanding that dangerous dogs need banned and not pit bulls. I would also like to say that Lisa Burton should face criminal charges and not just get a slap on the wrist. its the owners fult dogs are children in fur they need attion and disapline. the woman should have had better control of her dog. Its all about how you treat animal and raise it. I may have never been attacked by a dog but I don't believe putting a ban on this breed would hlep anything. Maybe people should take appliction to see if they capabile to take care of the animal and they must have to take classes before owning a dog. but you cant blame the dog for what the owner had done or taught the dog. stop and think people we dont go kill all one race because one man beats or kill his wife or things of that sort. why should we blame a breed?

I don't like pitbulls to begin with. But for any gog to attack a child, and bite him in the face. I'm sorry but it should be put down. Once a dog gets the tatse of it he will do it again. Pit bulls may be able to be trained but, as someone said before,it's instinct. And doberman's are no better.It can be done in a humane way. 35$ is a sad way to pay for injuries of the child. They just shouldn't be allowed within city limits any where.

TO SAM IN LINCOLN I RESENT THE FACT THE YOU AUTOMATICALLY ASSUME THAT ON OWNER OF A PITBULL IS NOT A LAW ABBIDING CITIZEN! THAT HAS TO BE THE MOST IGNORANT THING I HAVE HEARD! My pitbulls have been raised by many children and they have never been vicious towards them.

I personally think this case is purely the fault of Lisa Burton. No one should take an out of control dog in public if they can't control it. The woman was fifty-one, for crying out loud. She would never be able to control any dog if it decided it wanted to get away. Shame on her for not training her dog. Shame on her for taking her obviously aggressive dog out in public. Shame on her for not being able to control her dog. Shame on her for owning a breed that she is obviously not equipped to handle. But let's not blame the breed. Dogs must be taught aggression; it is not inherited. Aggression is a behavior, and behavior cannot occur without environmental stimulus. Aggression is a learned behavior, which means this dog's owner taught it to the dog, intentionally or not. Before we condemn innocent dogs to their death, lets go for the root of the problem: irresponsible owners. Pit bulls only make up for 13% of Lincoln's bites. Clearly breed is not the cause.
