Prisoners File Lawsuit Over Telephone

A lawsuit filed by Nebraska prisoners challenging rules to use the telephone is being allowed to move forward.

The rules include taping of conversations prisoners conduct with lawyers and the news media.

Some of those rules have been suspended pending court action on the lawsuit.

The state Attorney General's office argued the lawsuit should be dismissed, in part because the 1997 regulations did not violate Nebraska's wiretap law. The Attorney General's office argued that the plaintiffs would not qualify as an "aggrieved person" under the statute.

Lancaster County District Judge Steven D. Burns disagrees and he says the lawsuit can continue.
