A man is dead after a speeding train rammed his car early Thursday morning. The crash is so horrible it left the car unrecognizable.

Lincoln Police say Huy Nguyen drove around at least one other car waiting at the railroad crossing arms, maneuvered onto the tracks and died when the train slammed into his car.

Police said it happened just before 6:00 Thursday morning at the crossing near W "A" and SW 6th Streets. The police report also shows the Amtrak train has $2,000 in damage. Burlington Northern Santa Fe track is damaged to the tune of $3,000.

Passengers on the speeding Amtrak train didn't even realize there was a crash until the train stopped.

"I went up to the front of the car and looked down over the bridge and you could just see it disintegrated that car. There was nothing left of it. Didn't feel a bump. Didn't feel nothing. I woke up and saw lights out the window," said Amtrak passenger Richard Ater.

Emergency lights were rushing to the aid of 42-year-old Huy Nguyen, who was killed when the Amtrak train, traveling 50 mph, slammed into his car.

"People go around crossing arms unfortunately and I think a lot of people don't realize how fast Amtraks go," said Capt. Joseph Wright, Lincoln Police Department.

Amtrak officials are running an internal investigation, but spokesman Marc Magliari said, "There's nothing to indicate this was anything other than a driver who ignored the warning signals."

Amtrak wrapped up its Lincoln investigation at 10:00 Thursday morning.

The National Transportation Safety Board will not investigate since there is nothing suspicious. That means it's up to Lincoln Police to sort things out. They believe this is exactly as it appears; a man driving to work who made a terrible decision that cost him his life.

"From witness accounts of what happened, a vehicle stopped for the cross arms, the vehicle which was traveling westbound went around the cross arms and was hit by the train," said Wright.

As for the Amtrak train, no passengers or crew are hurt but those traveling from Denver to Chicago had to wait 5 1/2 hours while Amtrak made safety checks. However, few were as concerned with the wait as they were what happened to Nguyen.

"I was just like woah! I felt bad for the person who did get hit, even though he went around there, after I found out what happened and stuff. Just, for the family you know it's kind of sad that somebody did that and they lost a loved one," said Amtrak passenger Victoria.

The Federal Railway Administration is also looking into the crash and may still investigate. As of now they haven't made a decision, but according to FRA's investigation policy it is standard procedure to investigate any "passenger train incident resulting in at least one fatality."

FRA would then see if anything is wrong with the crossing arms. However, the Nebraska Public Service Commission said it doesn't recall any complaints about this rail-crossing.

No, I believe these people just think they can beat the trains. I live on D street and they are constantly speading around the arms. They can see the train but try to beat it. Risking hitting other cars, getting hit by a train or hitting childen in the area. It is just maddening!

Whether the gates are broken or not it is against the law to go around them. If people are that impatient take another route or give yourself more time. Look, Listen and Live is the quote, not I Am Just An Idiot. Do more research on Rail safety and technology before you speak out.

I recently lost my son due to him being hit by a train 11/01/09 but with the Grace of God I was able to have some of his organs donated and he lives on in 3 people 11/02/09. All I am asking please never walk by the railroad with headphones on listining to music. Please be a organ donnor! You give someone the gift of living on :-) Thank you from my heart and soul and my son soul.

Is it possible the railroad may be partially responsible. It appears the crossing arms "cry wolf" all the time. From what i've read, quite a number of vehicles go around the arms at this crossing. Fix this problem with the arms so local drivers believe a train is coming down the tracks.

Regardless of the arms being a consistent issue or not, you don't cross unless directed to do so. The most common train to cross that crossing is an Amtrak and those suckers blow through there. I hate to seem heartless, but that's what happens. There is no way he could have missed an Amtrak, that crossing has plenty of room to see to either direction. Bless him, but it was a stupid move that cost his life. I hope others take this as an example of what can happen when you're too impatient to wait for a train. You may get through faster, but you may be in a million pieces.

Just because the crossing arms are down and you don't see a train, doesn't mean there isn't one. The sensors which start the crossing gates are based on speed, and with Amtrack traveling at 50 mph on that track, those gates begin to go down when Amtrack is still a mile or so west of Yankee Hill Brick. If you stop and wait and there is no train, call the number on the signal shanty (silver building) next to the crossing, and BNSF will send someone out to look into the problem.

the last few months the guard rails have constantly been malfunctioning. i live and work in the area and have seen cops there for hours making cars turn around until they could get the arms back to working order. It always starts in the early morning. I wonder if he didnt see the Amtrack coming since it was moving so quickly and just figured it was malfunctioning yet again and would try and get through before the cops showed up to make him go around. I just think someone needs to look into these tracks more careful because maybe if they hadnt been malfunctioning so much within the last months this could have been avoided. Just something to think about.

ANONYMOUS~ Read a drivers manual.When the crossing arms are down,you stop.Its the law. Unfortunately maybe this driver had previously been late for work,& warned his job was on the line.He obviously was in a hurry & it cost him his life.

What an incredibly sad ending to an incredibly stupid decision...there is no appointment/job/anything that is so crucial that you should risk your life. Traffic/warning signs are the LAW, not a suggestion. Condolences to the driver's friends and family members.

this track always has the railroad arms down and no train I drive to work this way everyday and have seen more than 1 time people going around the arms because no train is coming I think the RR should look into this maby thats what this man thought no train was coming
