Nebraska High Court Upholds New Anti-Gang Law

The Nebraska Supreme Court has upheld a Nebraska anti-gang law challenged by an Omaha man who styled himself as a mobster straight out of the television series "The Sopranos."

The state high court also ordered that Steven Scott be resentenced in a move that will likely see him spend more time behind bars.

Scott was convicted last year of second-degree assault and use of a deadly weapon for a hammer attack on a former roommate who had declined to join Scott's gang "family." Scott also became the first person in Nebraska convicted of unlawful membership recruitment into an organization that engages in criminal acts -- a 2009 law targeting gang violence.

On Friday, the Nebraska Supreme Court rejected Scott's argument that the law infringes on a person's free speech rights.
