Nebraska Gov. Dave Heineman doesn't think it's hypocritical for the state to try to overturn federal health care reform while at the same time applying for money available under the law.

Nebraska is one of 20 states suing to toss out President Barack Obama's health care overhaul law. Seven of those states including Nebraska have applied for and received subsidies to help cover medical costs of retired employee.

Heineman is a vocal critic of the law, but he said that until courts stop it, states have an obligation to implement the law.

He says the state will apply for grants that make the most sense for Nebraska, including one that will help the state set up on online market called an exchange to shop for insurance plans. But the state will turn down others.
