Fremont Immigration Ordinance Fighting Uphill Battle
Fremont, Neb. When Fremont voters approved an ordinance banning the hiring and renting to illegal immigrants, they knew the courts would eventually get involved.

When Fremont voters approved an ordinance banning the hiring and renting to illegal immigrants, they knew the courts would eventually get involved.
Now some believe City Council might attempt to lose the court battle on purpose.
The ACLU and the Mexican American Legal Defense and Education Fund are putting pressure on the City of Fremont to put a stop to the newly passed ordinance.
The new law is set to take effect Thursday.
But the next two days could mean the end of the ordinance, at least for now.
On Wednesday, a federal judge will decide whether to temporarily block the new ordinance until the courts can determine the law's legality.
But on Tuesday, Fremont City Council will discuss suspending the new law until 14 days after the court cases are resolved.
Robert Hartwig, Fremont City Administrator, says, "There's some chance to get some cost-savings if you are proactive about it rather than reacting to a court injunction or restraining order."
City Council members may also decide who will defend Fremont in court.
Hartwig says, "They understand that the citizens are saying 'we want you to defend the ordinance and the city council intends to defend the ordinance."
But some supporters of the ordinance believe that might not be the case.
Jerry Hart is one of the petitioners responsible for getting the proposed ordinance to a city-wide vote. He says, "Since the city has fought this thing from day 1 and is continuing to fight it, whether it's going to be true or not, it's really going to look like they're trying to throw the suit if they don't get the best qualified person."
Hart believes that person is Kris Kobach, who defended the petitioners in front of the Nebraska Supreme Court years ago when the City Council rejected the law. City leaders have hinted they may look elsewhere.
Hartwig says, "They're looking at a lot of different options and Kris Kobach is one of the options that the council is looking at."
But Hart, says there is no one better than Kobach who specializes in immigration law and promised a free defense if chosen. "If you're really, really concerned about doing the will of the people, then you need to do that."
Hartwig adds, "We're going to look and really look carefully and pick the person that we think is the best person to defend the city."

I am not a member of your comunity but as a residnet in Dallas TX I have seen a lot crime, falling home values, failing schools and cost on the social system. I do not think the intent is to keep Femont "white" as some have posted - but to have law in order in ur comunity. Good luck to you it is a hard battle to fight if u do not have the support of your federal government -or the state. U should try to get a state law like OK to crack down on employers of the illegals.
Hopefully Lincoln adopts the same illegal immigrant law , we need it bad here....there are way too many of them all over the city .Illegals need to get legal just like everyone else and get off the welfare rolls it's not designed for you.

All I can say is; so much for we the people. We the legal citizens of this country. The, WE the people voted their will and now the government that is supposed to be we the people is taking the decision out of our hands. If they are illegal alliens then they should be deported and go through legal channels to come back. You go Fremont. Our federal government would get off of the pot and do something, then our local government needs to and should. To the federal courts, leave the locals alone. We the people haqve the say so. Isn't this our constitutional right? Oh, that's right, our president is trying to change the constitution too. He is special, he can do things any old way he wants. VOTE HIS A## OUT of office or IMPEACH him. We are the people and the governement, so let us make our own decisions and let them stand. Since the ploitcians are to scared to actually make a decision that might jeopordize their office. They are not there for the people the are there for their own agenda.

I personally don't see problem with the City of Fremont enforcing a law the feds have failed at. Unless, of course, you are one who is worried about seeing half of your extended family have to go home.
FIGHT THIS!!!!!!!!! Come on city council, Get the job done!! They dont want "Fremont white" Frito, they (we) want LEGAL. You already need to have documentation, or are supposed to, when you get a job.
Forget the cost of litigation. What about documentation? Every employment and tenant/landlord transaction must be document somehow, otherwise the law is discriminatory if it only applies to surnames/religion/national origin. And, if the packing plants stay in the area, 20 percent hispanic will grow. If you are serious about maintaining Fremont White Whatever, then get rid of the packing plants. Only a fraction of that demographic is actually undocumented.
